A workers' Comp accident History record should be obtained on all prospective employees on a post-offer-of-employment basis.
To comply with the hiring provisions of the Americans With Disability Act (ADA), the information obtained through a claims history search:
A. Should only be sought after a legitimate offer of employment has been extended to the applicant.
B. Must not be used to screen out or discriminate against a qualified individual with a disability because of the existence of the disability.
C. Must be kept separate from Personnel records in a confidential medical file.
